A federal court said Thursday that it will allow a US House election in South Carolina for Republican Rep.Ā Nancy Maceā€™s seat to proceed under a map it hadĀ previously declared unconstitutional.

In a brief order, the judges in the case said they had little choice, given a fast-approaching deadline to prepare for the primary election for the stateā€™s down-ballot contests.

Last year, the three-judge panel held that the stateā€™s GOP-controlled Legislature had ā€œexiledā€ more than 30,000 Black residents from the coastal 1stĀ Congressional District, which is anchored in Charleston County, in what the court called a ā€œbleachingā€ to benefit Republicans. That amounted to an unconstitutional racial gerrymander, the judges concluded.

I donā€™t think thatā€™s legal. Taxation without representation and whatnot

You could make the argument, but literally they have the right to elect someone. There is no legal right to not be gerrymandered, per SCOTUS

If weā€™re being technical, thereā€™s no legal right to no taxation without representation either.

They have no senate representation because they arenā€™t a state. They have a house seat
